Halifax Bank have informed me that i will have to persue the claim through Courts in Scotland ! is this true ?

I have managed to reclaim all my bank charges back from Natwest, no problems, but with The Halifax , they are informing me that all claims are on hold due to legal wranglings in Court ? i was led to believe that the Judgement went against the Banks !! Also they have informed me that if i persue them through the Courts , i will have to apply through the Scottish Courts ?? is this the case , it seems odd , or is this just a tatic to put people off !!
